  1. Introduction

The wicancer.org website and its webpages (the “Site”) are an online information and communications service provided by the Wisconsin Cancer Collaborative (“WCC”), and are subject to your agreement with the following terms and conditions.

  1. Acceptance of Terms and Conditions

Please read these Terms and Conditions before using the Site.  By accessing or using the Site, you agree to be bound by all the following terms and conditions.  WCC may modify the Terms and Conditions at any time, and the modifications shall be effective upon posting to the Site.  Users of the Site should periodically review these Terms and Conditions, and continued use of the website shall constitute your acceptance.

Your use of the Site is also conditioned on your acceptance and compliance with the WCC Privacy Notice.  The Privacy Notice describes the scope of the Site, and the privacy measures contained therein.

  1. Medical advice

The information provided on the Site is not intended nor implied to be a substitute for professional medical advice.  Always seek the advice of your medical provider with any questions you may have regarding a medical condition.  Nothing contained on the Site is intended to be for medical diagnosis or treatment.

The information contained on the Site is developed and provided in good faith, and reasonable efforts have been made to ensure that it is accurate and up to date.  However, WCC cannot be held responsible for the information provided on the Site.

  1. Ownership of the Site; Intellectual Property Rights

The Site contains certain information, designs, text, graphics, interfaces, images (and the selection and arrangements thereof), software, hypertext markup language (HTML), scripts, active server pages, materials, audio, videos, charts, and photographs, trademarks, logos, slogans, symbols, mascot, trade names, documentation, and other data (“Content”).  The Site and its Content are owned by or licensed to the Board of Regents of the University of Wisconsin System.  The Site and its Content are protected by certain copyrights, trademarks, trade dress, or other intellectual property rights (“Intellectual Property Rights”). You may not use, copy, reproduce, distribute, republish, or transmit the Site, its Content or any related Intellectual Property Rights except as expressly provided in these terms and conditions.

 

  1. Acceptable use of the WCC website

The Site provides information on the full continuum of cancer care.  To access the Site or some of the resources it offers, you may be asked to provide personal or professional information.  Users of the Site may join WCC as a member, register for events, read our periodicals, apply for grants, request to be a sponsor or exhibitor at events, and read, download, and print informational materials for non-commercial use.  The Site also features a member directory on the Member Center webpage in which individuals and organizations may voluntarily provide contact, scope of work, and location information.  The member directory is available to registered members only, and may be used to connect with other members.  The directory shall not be used for commercial purposes. Upon joining as a member, you agree to these Terms and Conditions.

It is a condition of your use of the Site that all the information you provide on the website is correct, current, and complete.  Upon becoming a member, you must provide a username and password, therefore, you must treat such information as confidential, and may not disclose it to another person or entity.  You agree to notify us immediately of any unauthorized access to your account, or any breach of security.  Furthermore, you consent to all actions we take with respect to your information that is consistent with our Privacy Notice.

The information contained on the Membership Directory may be used for non-commercial use. The rights approved to you in these Terms and Conditions are subject to the following restrictions:

  • you shall not sell, rent, lease, transfer, assign, distribute, host, or otherwise commercially exploit the Site;
  • you shall not change, make derivative works of, disassemble, reverse compile or reverse engineer any part of the Site;
  • you shall not access the Site in order to build a similar or competitive Site;
  • you shall not incorporate the Content into any database, data set, algorithm, AI model, compilation, archive, or cache;
  • you shall not access the Site or Content with any robot, spider, web crawler, web scraper, extraction software, or any other automated process or device to scrape, copy, or monitor any portion of the Site or any Content available through the Site;
  • you shall not delete or alter the copyright and other proprietary notices on the Site or Content; such notices must be retained on all copies.

 

  1. Prohibited use of website

WCC is not responsible for the content of members’ information, nor activity that occurs under your account.

Users of the Site shall not engage in the following activities with the website:

  • Unlawful, or promoting unlawful activity, that violates any federal, state, local, international law, or regulation.
  • Spam generated by machine or randomly, constituting unauthorized or unsolicited advertising.
  • Installing any viruses, worms, malware, trojan horses, or other content that is designed or intended to disrupt, damage, or limit the functioning of any software, hardware or telecommunications equipment, or to damage or obtain unauthorized access to any data or other information of a third party.
  • Violating the privacy of any person or entity.
  • Falsifying information and features.
  • Changing the content and design of WCC publications provided through this website.
  • Using any illustrations, photographs, video or audio sequences, or any graphics in the Content separately from the accompanying text.
  • Impersonating, or attempting to impersonate WCC, its employees, another user, or any other person or entity associated with the organization.
  • Accessing another member’s account on the member directory.
  • Modifying the content on another member’s profile, or deleting content on the profile, or removing another member from the directory.
  • Using individual and organization membership sites and lists for soliciting for-profit business activity or to fundraise for private interests.

 

WCC is not liable for third-party content on the Site, including any errors or omissions in content, loss or damage incurred as a result of your use of the Site.

WCC may terminate or suspend your membership immediately if you breach these Terms and Conditions.  WCC may take appropriate legal action, including referral to law enforcement for any illegal or unauthorized use of the website.

  1. Limitation of liability

THE SITE AND ITS CONTENT (WHETHER PROVIDED BY WCC, ITS AFFILIATES, YOU, OTHER USERS, OTHER AFFILIATES OR THIRD PARTIES) ARE PROVIDED ON AN “AS-IS” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WCC EXPRESSLY DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, WITH RESPECT TO THE SITE AND THE CONTENT, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NONINFRINGEMENT, AS WELL AS ANY ARISING BY OPERATION OF LAW OR FROM A COURSE OF DEALING OR USAGE IN THE TRADE.

In no event shall WCC, employees, officers, members or contracted third parties be liable for any direct, indirect, consequential, special, incidental, exemplary, or punitive or any other monetary or other damages, fees, fines, penalties, or liabilities arising out of or relating in any way to use of the Site or the Content.  A user’s sole and exclusive remedy for dissatisfaction with the Site is to stop using the Site.

  1. Choice of jurisdiction

These Terms and Conditions will be construed and enforced in accordance with the laws of the State of Wisconsin. Venue for any other dispute arising under this Agreement is exclusively in the state or federal courts located in Madison, Wisconsin and you expressly agree to the exclusive jurisdiction of those courts. Any cause of action or other claim with respect to the Site or the Content must be commenced within one year after the cause of action or claim arises.

  1. Links to external websites

The Site may link to websites of external organizations.  This does not signify that WCC has reviewed or endorsed the organization, its website or content, and WCC does not accept responsibility or liability for the content, operators, availability, accuracy, quality, advertising, products, services, or other materials on or available from the external websites.  The use of any linked websites is entirely at your own risk, and you are responsible for checking and complying with the terms and conditions of those websites.
